The Kogi state governorship tribunal sitting in Abuja has affimed the election of Usman Ododo as the duly elected governor of Kogi state. The tribunal, sitting in Abuja on Monday, dismissed the petition filed by Murtala Ajaka, the Social Democratic Party (SDP) governorship candidate, challenging the election results.
The Independent National Electoral Commission (INEC) had declared Ododo, the candidate of the All Progressives Congress (APC), as the winner of the election amid allegations of rigging and vote-buying. Ajaka and the SDP filed a petition contesting the election outcome, alleging irregularities and electoral malpractices.

The three-member panel of justices, headed by Justice Ado Birnin-Kudu, dismissed the petition of Murtala Ajaka, of the Social Democratic Party, for failure to substantially prove material facts in his petition as required by law.
The tribunal held that in line with section 135 of the Electoral Act, the petitioner failed to prove how the irregularities alleged were substantial enough to affect the entire election. MURTALA AJAKA cries out.

The court further held that the petitioner, according to law, is duty-bound to lead evidence to show that there was substantial inconsistency and also show how the irregularities are enough to affect the outcome of the election.
Chief Kanu Agabi (SAN); Alex Iziyon (SAN) and Emmanuel Ukala (SAN), who appeared for INEC, Ododo, and APC, respectively, argued that the petitioners did not list the name of the witness in their proof of evidence and that the witness statement on oath was not front-loaded alongside the petition. They also contended that the petitioners served the reports of the witness’ analysis on them 20 minutes before the commencement of the proceedings. MURTALA AJAKA cries out.
